This Privacy Policy outlines CAR FAYDA policies regarding the collection of personal information, use and discloser of any person, individual, subscriber, company, or any entity whose information is collected on our website and mobile software applications. All such person, individual, subscriber, company, or any entity shall be termed as “Customer”. The information and documents required or collected which means and car owner’s name, address, mobile number, email address, car photographs, color, make, model, variant, fuel type, registration date, manufacturing date, type of ownership, insurance status and history of vehicle shall hereby term as “Personal Information and Data” .

By using Car Fayda services, Sites, Applications, offers, customize plans, monthly plans, promotional vouchers, and any form of services, you agree to the terms of this Privacy Policy and Terms of Use.

CUSTOMER ASSENTS AND UNDERTAKES BY SUBMITTING ITS PERSONAL INFORMATION AND DATA TO CAR FAYDA, CUSTOMER ARE CONSENTING TO THE USAGE OF YOUR PERSONAL INFORMATION AND DATA IN DELHI OR IN ANY OTHER COUNTRY IN THE WORLD AND TO CAR FAYDA’S USE OF PERSONAL INFORMATION AS MENTIONED IN THIS PRIVACY POLICY. IN THE EVENT IF THE PERSONAL INFORMATION IS SUBMITTED OF THIRD PARTY TO CAR FAYDA, THE INFORMATION PROVIDER OR CUSTOMER WARRANTS AND REPRESENT TO HAVE CONSENT AND AUTHORIZE TO PASS THE THIRD PARTY PERSONAL INOFRMATION TO CAR FAYDA AND HOLD CAR FAYDA HARMLESS FROM AND AGAINST ALL OF ANY CLAIMS

  1. COLLECTED PERSONAL INFORMATION – While using Car Fayda’s services, all personally identifiable information and data sent to Car Fayda by Customer shall be subject to Car Fayda’s Privacy Policy. Such information will be collected and transmitted to the Delhi and/or other countries, using any technology infrastructure, for processing, use and storage by Car Fayda, its Affiliates, and/or their respective agents in connection with performance of Car Fayda’s obligations hereunder or as otherwise described in Car Fayda’s
    Privacy Policy, and Customer hereby consents to such collection, transfer, disclosure, storage, and use.
  2. PROVIDED PERSONAL INFORMATION – Customer assents and undertakes that it is providing the personal information and Data with free will and voluntarily and furthermore is capable enough to provide such information. The collected personal information will include the following: car owner’s name, address, mobile number, email address, car photographs, color, make, model, variant, fuel type, registration date, manufacturing date, type of ownership, insurance status and history of vehicle form or any transactions Customer conduct on the websites or offline with Car Fayda.
  3. PERSONAL INFORMATION USAGE – Car Fayda uses the personal information and Data to submit the same, “as it is”, to the appropriate Ministry of Road Transport and Highways- Government of India for issuance, re-issuance or modification of Registration of Vehicle of the Customer.
  4. PERSONAL INFORMATION AND DATA DISCLOSURE – Disclosure of personal information can be done in following circumstances: (A) Is Known, or hereafter becomes, through no act or failure to act on the part of the Car Fayda, generally know or available; (B) Is known by the Car Fayda without any obligation to keep such information and Data confidential at the time of receiving such information as evidenced by its contemporaneous written records; (C) Is hereafter furnished to the Car Fayda by a third party, as a matter of right and without restriction on disclosure; (D) Is independently developed by the Car Fayda without any breach of this Agreement, as evidenced by its contemporaneous written records; (E) Is the subject of a prior written permission to disclose provided by the disclosing party; (F) Is disclosed in response to a valid order of a court or other governmental body; or (G) Is necessary to establish rights or enforce obligations.
  5. CUSTOMER’S RIGHT AND CHOICE ON INFORMATION – Should Customer desires to stop receiving further communications or newsletter from Car Fayda, Customer will have the choice to click on “Not Required” tab to unsubscribe itself for future newsletter, updates or promotional offers from Car Fayda. However, there is a possibility that Car Fayda, may send Customer e-mail regarding updates to legal notices applicable to the account Customer created with Car Fayda. As and when required, Car Fayda may also contact Customer via telephone to offer plans or services which Car Fayda believes may be lucrative to Customer. Should you prefer not to receive such calls,
    please advise the representative who contacts you or contact customer service?
  6. THIRD PARTY LINK – Car Fayda may include links to other web sites or other Internet sources. Insofar as the Car Fayda cannot control these external sites and sources, it cannot be held responsible for the provision of these external sites and sources, and cannot bear any responsibility for the content, advertising, products, services or for any other material available on or via these external sites or sources. Furthermore, Car Fayda cannot be held responsible for any consequent damage or loss occurring or alleged, in
    relation to the use of or the fact of having trusted the content, goods or services available on these external sites or sources.
  7. COOKIES: “Cookies” are pieces of information that may be placed on your computer by a web site for the purpose of facilitating and enhancing your communication and interaction with that web site. Many web sites use cookies for these purposes. We may use cookies to customize your visit to the Web site and for other purposes to make your visit more convenient or to enable us

  8. GOVERNING LAW. This Agreement will be governed by the laws of the Delhi as applied to agreements entered and performed entirely within the jurisdiction of Delhi.

ARBITRATION – Any dispute, controversy or claim arising out of or relating to this Agreement, or the breach, termination, or invalidity thereof, shall be first attempted to be settled amicably by negotiations between the Parties, and if not amicably settled, finally settled in arbitration in accordance with applicable Arbitration and Conciliation Act in Delhi. The place of arbitration shall be Delhi. The arbitration shall be conducted in English language through the arbitration of a sole arbitrator to be appointed by Car Fayda. The costs of arbitration shall be borne equally by Customer. The award of arbitrator shall be final and binding on both the Parties.
